The landowner is in appeal seeking enhancement of compensation for the acquired land. Along with the appeal, an application seeking condonation of delay of 554 days in filing thereof has also been filed.

Briefly the facts of the case are that vide notification dated 19.07.2002 issued under Section 4 of the Land Acquisition Act, 1894 (for short “the Act”), the State of Haryana sought to acquire land measuring 239.87 acres situated in the revenue estate of village Patti Gaddar, District Kaithal for residential and commercial Sector -18, Kaithal. The same was followed by notification dated 17.07.2003, issued under Section 6 of the Act. The Land Acquisition Collector (for short, 'the Collector') vide award dated 16.7.2005 assessed the market value of the acquired land @ 5,00,000/- per acre. Dissatisfied with the award of the Collector, the landowner filed objections. On reference, the learned court below assessed the market value of the acquired land @ 300/- per square yard.

At the time of hearing, no one has appeared for the landowner. Other cases arising out of the acquisition have already been decided by this Court vide judgment in RFA No. 2218 of 2007—Smt. Maya

and others Vs. State of Haryana and others, dated 23.01.2012, whereby compensation for the land acquired vide same notification was determined at ` 280/- per square yard. Hence, no case for enhancement of compensation can possibly be made out.

For the reasons mentioned above, the present appeal is dismissed. Consequently, the accompanying applications are also dismissed.
