Petitioner has approached this Court claiming the

higher scale in pursuance to the Assured Career Progression Scheme (for short, 'ACP Scheme') formulated by the State of Haryana.

It is the contention of the petitioner that he was entitled to the next grade as per the ACP Scheme after completion of 11 years of service and the second grade after 17 years of regular satisfactory service. He contends that he has completed the requisite

period but the said relief has not been granted to the petitioner.

Claiming the said relief, petitioner had submitted a representation dated 26.8.2011 (Annexure P-9) to the Chief Engineer, Panchayati Raj, Public Works Haryana, respondent No.2 which has been forwarded by the Superintending Engineer vide his letter dated 15.2.2011 (Annexure P-11). The Chief Engineer, Panchayati Raj, has also recommended the claim of the petitioner and referred to the same to the Financial Commissioner and Principal Secretary to Government of Haryana, Development & Panchayat Department, vide Communication dated 27.2.2011 (Annexure P-12). The matter is pending at this stage.

Counsel for the petitioner submits that the petitioner, at this stage, would be satisfied if a direction is issued to the Financial Commissioner and Principal Secretary to Government of Haryana, Development & Panchayat Department, respondent No.1, to consider the representation of the petitioner dated 26.8.2011 (Annexure P-9) as recommended by the Chief Engineer, within some specified time.

Counsel for the respondents does not have any objection to the prayer made by counsel for the petitioner.

In view of the above, without going into merits of this case or commenting thereon, this writ petition is disposed of

with directions to the Financial Commissioner and Principal Secretary to Government of Haryana, Development & Panchayat Department, respondent No.1, to consider and decide the representation of the petitioner dated 26.8.2011 (Annexure P-9) within a period of three months from the date of receipt of certified copy of the order. The decision so taken be conveyed to the petitioner forthwith. In case the claim as made through representation dated 26.8.2011 (Annexure P-9) by the petitioner is accepted, consequential benefits be released to the petitioner within a further period of two months.
