Suo Muto notice was taken in this matter, on the basis of News Item in “The Chandigarh Tribune” dated 21.9.2012 bringing to the notice of its readers the plight of a woman, aged 85 years, who had been turned out to live at the mercy of others, though she had eight children- five sons and three daughters. The police had come to her rescue and sent her to Old Age Home to live without any family support system, which she required at such an advance age.

For this reason cognizance was taken by this Court, in as much as the Parliament has enacted the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. The anxiety of the Court was the enforcement of the provisions of the said Act in the States of Punjab, Haryana and U.T. Chandigarh, because for implementation of the provisions of the said Act, Tribunal under Section 7 of the Act is to be constituted likewise, Conciliation Officer as provided under Section 5 read with Section 18 of the Act are to be appointed.

After the notice of motion, States of Punjab, Haryana and U.T. Chandigarh have responded. They inform the Court that in exercise of powers conferred by Section 32 of the said Act, the States of Haryana, Punjab and U.T. Chandigarh have framed the Rules. Tribunals have also

been constituted and Conciliation Officers appointed.

In view thereof, we close the present matter. It has served its purpose. However, we would only expect the authorities to give the due publicity to the promulgation of the aforesaid Rules as well as the constitution of the Tribunals, so that necessary awareness is brought to the notice of the senior citizens, to have access to the Tribunals.
