The learned counsel for the petitioners contended that under Section 6 read with Section 7 of the Wakf Act, 1995, bars jurisdiction of the Civil Court only to the extent of trial of the suits regarding questions specifically enumerated therein. Provision of Section 85 of the Act bars jurisdiction of Civil Court which is wider as compared to Sections 6 and 7 of the Act . The jurisdiction of the Wakf Tribunal is only with regard to the matters falling under Sections 33, 35, 47, 48, 51, 54, 61, 64, 67, 72 and 73. Learned counsel for the petitioners contended that Sections 6 and 7 of the Act do not empower the Tribunal to decide with regard to the eviction of the petitioners. He has relied upon a judgment of the Apex Court in the case of Ramesh Gobindram (Dead) through LRs vs. Sugra Humayun Mirza Wakf reported in (2010) 8 Supreme Court Cases 726. The matter has been considered by the Hon'ble Supreme Court in the said judgment. In order to properly appreciate the contention of the learned counsel for the petitioners, reference to the provisions of Sections 6 and 7 of the Act would be necessary, which are reproduced here under:-
