Counsel would refer to memo dated 14.7.2009 issued by the office of Directorate (Secondary Education), Department of Education, State of Punjab, whereby the approval for promotion of the petitioner, who is holding the post of Workshop Attendant to the post of Sewing Teacher had been duly accorded and thereafter in terms of communication dated 16.11.2010 issued by the office of District Education Officer (School),

Gurdaspur, the petitioner has been informed that she cannot be held eligible for promotion to the post of Vocational Teacher (Sewing Teacher) in terms of guidelines entered in a Gazette notification. In this very communication, it has also been recited that her case had been forwarded to the department for final decision.

Learned counsel would argue that the precise guidelines that find a mention in the communication dated 16.11.2010 (Annexure P5) have not been furnished to the petitioner and still further in spite of that her case for promotion having been forwarded to the department, no final decision as regards her claim for promotion as Sewing Teacher has been communicated to her till date.

It has been brought to the notice of this Court that even a legal notice dated 28.6.2012 (Annexure P6) already stands served upon the respondent-authorities but the same has not got any response.

In view of the facts noticed hereinabove, I deem it appropriate to dispose of the writ petition with a direction to the respondents to take a final decision on the legal notice (Annexure P6) strictly in accordance with law and by passing a speaking order within a period of four months after the receipt of a certified copy of this order.
