Learned counsel appearing for the petitioners contends that the service rendered by the petitioners in the aided Schools before the same being taken over by the State Government would have to be taken into account for purposes of pension as also other retiral benefits. Towards such submission, counsel relies upon a judgment of the Apex Court rendered on 05.12.2007 (Annexure P-2). Counsel further submits that identical relief had already been granted and released by the State Government vide order dated 31.12.2009 (Annexure P-3).
Without making any observation as regards the merits of the claim raised by the petitioners in the present writ petition, I deem it appropriate to dispose of the present writ petition with a direction to respondent/authorities to consider the claim of the petitioners as raised in the present writ petition in the light of the judgment of Hon'ble Supreme Court dated 05.12.2007 (Annexure P-2). Such exercise be done within a
