Petitioner, who is 100% blind and at present working as a Tabla player on regular basis since 20.5.1993, claims promotion to the post of Music Teacher for which post, according to the petitioner, he fulfils all the qualifications. The cases for promotion to the post of Music Teacher were called for in the year 2008. The case of the petitioner was also forwarded by the Principal, Government Model Senior Secondary School, Ismailabad, District Kurukshetra on 10.11.2008. The same was returned on the ground that the vacancies were not available. Petitioner served a legal notice claiming promotion to the post of Music Teacher.

Notice in this case was issued to the respondents but till date no reply has been filed despite availing five opportunities.

Counsel for the petitioner submits that during the pendency of the present writ petition, vide letter dated 21.4.2011, Director School

Education, Haryana called for the cases of eligible Tabla Masters for promotion to the post of Music Teacher. In pursuance to the said letter, the case of the petitioner for promotion to the post of Music Teacher has been forwarded by the Principal of the School where the petitioner is serving but till date no decision thereon has been taken or conveyed to the petitioner.

Counsel for the petitioner states that the petitioner, at this stage, would be satisfied if a direction is issued to the Director, School Education Haryana-respondent No.2 to consider the claim of the petitioner for promotion to the post of Music Teacher, which has been duly forwarded by the Principal of the Government Model Senior Secondary School, Ismailabad, District Kurukshetra within some specified time.

Without going into merits of the case or commenting thereon, the present writ petition is disposed of with a direction to the Director, School Education Haryana-respondent No.2 to consider and take a decision on the promotion case of the petitioner, which according to the petitioner has been forwarded by the Principal of the Government Model Senior Secondary School, Ismailabad, District Kurukshetra, where the petitioner is serving as a Tabla Player in pursuance to the communication dated 21.4.2011, within a period of two months from the date of receipt of certified copy of the order. Decision so taken be conveyed to the petitioner forthwith.
