The petitioners pray for issuance of a writ in the nature of mandamus, directing the respondents to ensure that dirty water does not stagnate in the village.

An affidavit filed on behalf of respondent No.3, in Court today, is taken on record. Paras No.3 and 4 of the affidavit, read as under: -

“3. That the Block Development & Panchayat Officer, Bapoli vide meme No.1021 dt. 1.5.2012 has

submitted that due to the standing crops in the adjoining fields and the encroachment on the periphery of the pond in dispute, the standing dirty water of the street could not be completely drained out. It has been submitted by Block Development & Panchayat Officer Bapoli that the work on the site in question is in progress and a deep and a long trench is being dug on the one side of the pond/Johar so that the stagnated water on the street can be deviated in this trench. Now, the standing dirty water of the street has been disposed in a corner of the pond which is flowing in slow motion. True copy of report of BDPO Bapoli along with recent photograph are annexed herewith for kind perusal of Hon’ble Court as Annexure R3/1 and R3/2 respectively.

4. That the Gram Panchayat Pasina Khurd has filed an application u/s 7 (2) of Punjab Village Common Land

Act for ejectment of the respondent from the land in dispute which is pending for adjudication and fixed for 4.5.2012. True copy of application/petition filed by the Gram Panchayat Pasina Khurd is attached herewith as Annexure R3/3 for kind perusal of the Hon’ble High Court.”

We have heard counsel for the petitioners and in view of the above affidavit, direct the ADC/DC, Panipat, to ensure that dirty water does not stagnate in the village or in the fields, adjacent to the abadi of the village. It shall be responsibility of the ADC/DC to ensure that the needful is done expeditiously, preferably within three months.

The writ petition is disposed of, accordingly.
