The brief facts of the case are that on the demise of Sh. Nahar Singh, Lambardar of Village Barsal, Tehsil Jagraon, District Ludhiana on 16.08.2011, the post of Lambardar fell vacant. The District Collector vide order dated 09.11.2001 directed to initiate the process to fill up the said vacant post which has been caused on account of death of Nahar Singh. In pursuance of the order of Collector, proclamation was got conducted in the village on 12.12.2001 and three applications of Gurnek Singh, Harbhagwan Singh-petitioner and Gurbax Singh- respondent No.2 were received up to 28.12.2001 for the post of Lambardar. Subsequently, Gurnek Singh withdrew his name in support of the petitioner and contest remained between Harbhagwan Singh-petitioner and Gurbax Singh- respondent no.2. After considering the candidatures of both the applicants, Naib Tehsildar recommended the name of petitioner-Harbhagwan Singh to the SDM, Jagraon who also concurred with recommendation of the Assistant Collector IInd Grade, forwarded the case to the Collector. The District Collector after appreciating the merits of the respective candidates appointed petitioner – Harbhagwan Singh as Lambardar of Village Barsal, Tehsil Jagraon, District Ludhiana vide order dated 07.02.2003 (Annexure P-1).
