Tehsil Thanesar, District Kurukshetra. After summoning the parties and hearing the objections of the parties, the partition has been allowed to continue. It is important to note here that application for partition has been filed on 29.12.2001, as is clear from the reading of vernacular of Annexure P-13 to which the petitioner filed written statement on 24.09.2002 (Annexure P-11). Application for raising the question of title has been filed after Naksha Alaf was called and proposed mode of partition has been prepared. At this stage, application has been filed raising question of title. Application has been rejected by the Assistant Collector, 1st Grade, Thanesar. Thereafter, petitioner preferred appeal before the Collector which too has been rejected. Against that order, petitioner preferred revision before the Commissioner, Ambala Division which too has been dismissed on 17.12.2003. Against that order, petitioner filed a revision before the Financial Commissioner; it has been accepted by the Financial Commissioner vide order dated 15.6.2005 (Annexure P-16) and the case has been remanded to the Assistant Collector, 2nd Grade to decide afresh the issue after giving opportunities to the parties. Application dated 03.10.2002 had also been rejected by the Assistant Collector, 1st Grade vide order dated 07.11.2006.
