Secretary, Cooperation, Union Territory, Chandigarh who set aside the order dated 05.05.2005 and remanded the case for fresh decision on merits. In these circumstances, in the fresh approach before the RCS, the matter was reconsidered on merits. A detailed judgment was passed dated 07.02.2008 and after letting in pleadings and receiving written arguments and affording opportunity of hearing to both sides. Against the impugned resolution dated 27.01.2001, the Additional Registrar exercising powers under Section 55(1) (b) of the Act held that the application under Section 55 (1) (b) was not maintainable; the allegations levelled by Zorawar Singh regarding his signature on the proceedings/notice issued by the Society have been forged was not found acceptable in absence of any evidence in support of his claim. On examining the resolution in original along with the copy of approval letter of amendment dated 08.07.2002 duly bearing the signature and seal of the Assistant Registrar, Cooperative Societies the authority dismissed the application. The order passed by the Additional Registrar is a detailed speaking order which also narrates the history of the matter.
