Learned counsel for the petitioner has contended that Sirish Kumar, auditor from the head office of the company came to the branch of the petitioner on 8.10.2011 to inspect the branch. According to him, the petitioner opened the strong room and one by one, the trays having gold packets were supplied to him. Sirish Kumar claimed one packet of gold weighing 254.1 gms to be missing. He has submitted that the gold packets should have been examined in the strong room itself, but contrary to the said requirement, Sirish Kumar brought the gold packets to the public area. According to him, for a few minutes, Sirish Kumar left that place and the person deputed from the office to be with him had also left the place during that time. He has submitted that in this period, the gold packet might have been lost. He has further submitted that the allegations of the company against the petitioner are also contradictory. According to him, while in Annexure P7, it is alleged that the petitioner had handed over the first key of the safe to the junior staff and allowed him to enter the safe room in the branch when ABH was on leave, in the FIR the loss is said to have been caused due to theft committed by the accused.
