This is a petition under Section 482 Cr.P.C. for setting aside the impugned order dated 7.2.2011 passed by learned Additional Sessions Judge, Jind, vide which the application for superdari moved by the petitioner in case FIR No.239 dated 14.9.2008 under Sections 302/307/323/324/148/149 registered at Police Station Uchana was dismissed.
Learned counsel for the petitioner submits that the petitioner has been convicted in the aforementioned FIR and the appeal against his conviction is pending before this Court. Therefore, he prays that he may be allowed to withdraw the present petition with liberty to move an application before the Division Bench where the appeal is stated to be pending.
Dismissed as withdrawn with liberty as prayed for.
