The petitioner has been in custody for the last more than two years for having allegedly committed rape upon Ranjit Kaur on 9.8.2010. The case of the prosecution is that the prosecutrix born on 2.11.1993, had been sexually assaulted by the petitioner against her wishes.
Counsel for the petitioner has vehemently urged that the circumstances brought on record clearly indicate that it is a case of consent.
I have heard counsel for the parties an gone through the statement of the prosecutrix, made in the court. It will not be appropriate at this stage to enter into the niceties of the trial to appreciate the authenticity of her statement. No ground is made out for grant of bail.
Dismissed. However, the trial court is directed to expeditiously conclude the trial, preferably within a period of six months. In case the trial is not concluded within the above said period, it will be open to the petitioner to approach this court again.
