The petitioner is alleged to have fired at police party causing no injury to anyone, whereas, co-accused of the petitionerPalwinder Singh had received lacerated punctured wounds with blackening and tatooing. Seven witnesses have already been examined. Chances of tampering with the evidence is remote, as all the witnesses are of official witnesses. The petitioner has been in custody w.e.f 21.09.2010. The petitioner remained admitted in the hospital till April, 2011 having been injured by the gun-shots of the police party.
In view of the above circumstances, the petitioner can be granted the concession of bail, as he has not been attributed any injury on person of any member of the police party. The petitioner is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of Trial Court.
