Poonam Rani Vs State of Punjab

The present petition has been filed by the petitioner under Section 439 Cr.P.C. seeking regular bail in case FIR No.44 dated 20.05.2012, registered under Sections 376, 312, 313, 201, 120-B of the Indian Penal Code, at Police Station Nangal, District Roop Nagar.

The learned counsel for the petitioner contends that the allegation against the petitioner is that she helped in getting the pregnancy of the complainant, Kiran Bagum, terminated with the help of one Raj Kumar. However, the alleged doctor and the clinic are not found at the address furnished by the complainant.

Kumar, refers to the statement of the prosecutrix recorded in the trial Court, and states that the prosecutrix has not supported the case of the prosecution.

In view of the fact that the prosecutrix has not supported the case of the prosecution, without adverting to the merits of the case, the present petition is allowed. Petitioner-Poonam Rani be admitted to bail during the pendency of the trial subject to his furnishing bail bonds to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Roop Nagar.
