Prayer in the present petition is for issuance of direction to respondent No. 2 and 3 to take necessary legal action on the complaint filed by the petitioner against respondent no. 4, for kidnapping his minor daughter Navpreet Kaur, which was later on converted into FIR No.111 dated 29.12.2011 under Sections 363, 366(A), 120-B IPC, PS Dhariwal, District Gurdaspur under the garb of order dated 05.01.2012.

Learned counsel for the petitioner contends that the respondentPolice is not proceeding against respondent No. 4 on account of the order dated 05.01.2012 passed in CRM M 404 of 2012.

The apprehension of the petitioner is misconceived. A perusal

of order dated 05.01.2012 passed in CRM M 404 of 2012 shows that the only direction issued by this Court was to the respondent No. 2, to look into the grievances of the petitioners and if found necessary, take appropriate measures in accordance with law.

The said order is not an observation on the validity of the marriage between the parties or otherwise. Therefore, it does not come in the way of initiating or pending criminal proceedings if any criminal offence is made out.
