The present petition has been filed for anticipatory bail under Section 438 of Code of Criminal Procedure in FIR No.81 dated 16.05.2011 registered under Sections 399, 402 of the Indian Penal Code, at Police Station Moga City, District Moga.

I have heard learned counsel for the parties and have gone through the whole record including the impugned order passed by learned

Additional Sessions Judge, Moga dismissing anticipatory bail application filed on behalf of the petitioner.

Co-ordinate Bench of this Court passed the following order on 23.08.2011:-

“Learned counsel for the State submitted that on application filed by the father of the petitioner an inquiry is being conducted by Superintendent of Police, City Moga though the investigating officer remain the same.

Let counsel for the State apprise the court as to why parallel inquiry was being conducted contrary to the instructions issued by the Director General of Police, Punjab.

Adjourned to 26.09.2011.

In the meantime, let the petitioner appear before the Investigating Officer on 05.09.2011 at 10.00 am to join investigation, however, in case of arrest, the petitioner shall be released on furnishing of bail bonds to the satisfaction of the Arresting/Investigating Officer. He shall appear before the Investigating Officer as and when called upon for further investigation. He shall also be bound by all the conditions as contained in Section 438(2) Cr.P.C.”

It has been contended by learned counsel for the petitioner that he has already joined the investigation pursuant to said order dated 23.08.2011.

It has also been stated by learned counsel for the State that petitioner has joined the investigation and that he is no more required for any custodial interrogation. It has also been stated that the petitioner is not involved in any other case.

There are no allegations on behalf of the State that petitioner is likely to abscond or that he is likely to dissuade the witnesses from deposing true facts in the Court, if released on bail.

Hence, in view of these facts and without expressing any opinion on the merits of the case, the anticipatory bail application filed on behalf of petitioner Rupinder Singh alias Pinder Singh is accepted and order dated 23.08.2011 granting interim bail in favour of the petitioner is, hereby, made absolute subject to compliance of conditions specified under Section 438(2) Cr.P.C.

The present petition stands disposed of accordingly.
