Petitioner through the instant petition under Section 482 Cr.P.C., has sought a direction for legal action against his elder brother Gurdev Singh, his father and others alleging that Gursewak Singh had been killed by his father and other brothers. He had sent a complaint to the office of Hon'ble the Acting Chief Justice which was treated as petition.
Notice was issued to the State.
In the reply filed, it has been informed that son of the petitioner had died in an accident with some unidentified vehicle and an FIR under Section 304 A IPC, stands recorded. An enquiry was conducted on the application filed by the petitioner. The Deputy Superintendent of Police, City Moga has placed a report to the effect that during enquiry nothing has come into evidence to establish that Gursewak Singh was murdered and that the case is being investigated deeply.
In view of the matter having already been looked into by the competent authority, no case is made out for issuing any direction. In case any enquiry into the allegation of murder resulting in unnatural death of Gursewak Singh is pending, it is directed that the same may be enquired within a period of three months.
