Learned State counsel, on the instructions of SI Surjit singh informs that a complaint has been received on behalf of Mandeep Singh against the petitioner, which is being inquired into by DSP Khanna. The period since when the complaint is pending could not be disclosed by the police official. Taking into consideration the totality of the circumstances, I am of the considered opinion that the apprehension of the petitioner, who is a female, that she would be harassed by respondent No.5, who is at a superior position to the petitioner, being incharge of the school where she is teaching, is not unreasonable as respondent No.5 is vindictive against her on account of the complaint having been filed against him by her. Interest of justice would be adequately met in case the right of liberty of the petitioner is secured, simultaneously by not prejudicing the rights of the State authorities to look into the allegations, if any, against the petitioner, striking a balance between the rights of both the sides, it is ordered that in case the petitioner is required to be arrested in any case registered at the instance of Mandeep Singh respondent No.5, she will be given a seven days notice in writing by the arresting officer. This order will remain operative for a period of one year and will be applicable in the circumstances, mentioned herein above. It is also made clear that in case the petitioner is required to join any investigation ( not as an accused), provisions of Section 160 Cr.P.C. will be complied with.
