Present petition has been filed under Section 439 of the Code of Criminal Procedure for the grant of regular bail to the petitioner in a case arising out of FIR No.56, dated 5.2.2012, registered at Police Station Sampla, District Rohtak, under Sections 302/201/202/34 of the Indian Penal Code.
Learned Counsel for the petitioner states that the only allegation against the petitioner is that the petitioner was aware of the alleged offence but he has not informed about the same to the concerned authorities, and for that reason, he has been involved under Section 202 IPC. Learned Counsel for the State, after seeking instructions from ASI Balram Singh, does not deny this fact that the petitioner has been implicated with the aid of Section 202 IPC.
Keeping in view the above facts, however, without expressing any opinion on merits of the case, present petition is accepted and petitioner is ordered to be released on bail to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, Rohtak.
