This Court, on 23.1.2012, had passed the following order:-

“The present petition has been filed under Section 438 Cr.P.C. for grant of pre-arrest bail to the petitioners in case arising out of Complaint bearing No. 39 dated 18.2.2010 under Sections 3 and 4 of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 and under Sections 323, 506 and 34 IPC.

Learned counsel for the petitioners submits that the petitioners, in a private complaint, have been summoned vide summoning order dated

12.7.2011 (Annexure P2). He further submits that since no investigation is required, petitioners are ready and willing to appear before the Summoning Court.

Issue notice of motion for 13.2.2012. Process dasti.

In case, the petitioners appear before the Summoning Court, on or before 3.2.2012, they shall be released on interim bail.”

Learned counsel for the petitioner submits that in compliance with the order dated 23.1.2012, passed by this Court, the petitioners have appeared before the Summoning Court and they have been released on interim bail. Further submits that during the pendency of the trial, the case has been committed to the Court of Sessions.

In view of the compliance of the order dated 23.1.2012, the present petition is accepted and interim pre-arrest bail, granted to the petitioner, is made absolute subject to their furnishing of fresh bail bonds to the satisfaction of the trial Court.
