Thakur Singh etc. Vs State of Punjab

This petition under Section 439 Cr.P.C. is for grant of regular bail during the pendency of the trial in case FIR No.78 dated 17.12.2011, registered under Sections 323, 324, 148, 149 of the Indian Penal Code (for short, 'the IPC') and later on added Sections 307, 326, 325 IPC, at Police Station Rureke Kalan, District Barnala.

The learned counsel for the petitioners contends that the FIR was initially registered under Section 323, 324, 148, 149 IPC and Sections 307, 326, 325 IPC were added later on. Now, Section 307 stands deleted.

complainant has been examined. The petitioners are in custody since 23.12.2011. The trial is not likely to be concluded in the near future. Therefore, no purpose would be achieved by keeping the petitioners in further incarceration.

Accordingly, without adverting to the merits of the case, the present petition is allowed. The petitioners be admitted to bail during the pendency of the trial subject to their furnishing bail bonds to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Barnala.
