Hari Charan Vs Additional District Judge, Faridabad

The present revision petition has been filed for issuance of directions as regards a reference bearing L.A.C No.267 of 20.9.2004 titled as Mrs. Kartari Devi Vs. State of Haryana etc., which is pending in the Court of Additional District Judge, Faridabad. Vide order dated 19.12.2011 this Court while noticing the fact that a petition under Sections 18/30 of the Land Acquisition Act is pending before the Additional District Judge, Faridabad since the year 2004 and has not been decided so far. Accordingly, comments of the Presiding Officer were called for. In deference to the order dated 19.12.2011 a communication dated 18.1.2012 has been sent by the Additional District Judge, Faridabad and the same is taken on record.

Suffice it to submit that the reasons disclosed in the communication dated 18.1.2012 do not inspire much confidence. The petition under Sections 18/30 of the Land Acquisition Act has been pending for the last almost 8 years and there can be no justifiable reasons for such an inordinate delay in keeping the matter pending.

It would be, accordingly, in the fitness of things to direct the Additional District Judge, Faridabad to decide the reference bearing L.A.C. No. 267 of 20.9.2004 titled as Mrs. Kartari Devi Vs. State of Haryana expeditiously and in any case not later than three months from the date of receipt of a certified copy of this order.

Revision petition is disposed of accordingly.
