The order dated 03.09.2012 passed by the Civil Judge (Junior Division), Chandigarh, dismissing the application filed by the plaintiffpetitioner (hereinafter referred as 'the petitioner') under Section 151 CPC for removal of obstruction created by the defendants-respondents by putting the lock over the demised premises (hereinafter referred as 'the respondents'), is under challenge.
The order rejecting the application for directing the respondents to remove the lock and provide access to the petitioner in the house in dispute, is an order of temporary injunction in the mandatory form, passed under Section 151 CPC, which is amenable to appeal.
As such, this petition being not maintainable is dismissed.
However, the petitioner would be at liberty to avail the
remedy, as provided under law.
