Challenge in the present petition is to the orders passed by the learned courts below on an application filed by respondent nos. 1 to 5/plaintiffs under Order XXXIX Rules 1 and 2 CPC.
At the time of hearing, learned counsel for the parties pointed out that the entire evidence has already been led before the learned trial court and the case is now fixed for arguments.
Considering the stage of the trial, I do not find any reason to interfere with the impugned orders at this stage. Accordingly, the petition is dismissed.
