Challenge in the present petition is to the order dated 11.4.2012, passed by the learned court below, whereby the application filed by the petitioner for getting the signatures of the respondent on a complaint filed to the police, compared with her admitted signatures on the written statement and the affidavit filed in court, was dismissed.

In the present case, the petitioner was permitted to prove a complaint filed by the respondent to the police, while leading secondary evidence, which though had been placed on record before the court below as mark `B', but before even taking any step to prove the document by way of secondary evidence, the application in question was filed, which was dismissed by the learned court below.

Learned counsel for the petitioner submitted that before the document in question is proved and exhibited before the court below by leading secondary evidence, the application filed by him for comparison of the signatures was pre-mature. The same could be filed at the late stage in

case the need arose. He submitted that he may be permitted to withdraw the present petition with liberty to file another application for the same relief in case after proving the document in question by leading secondary evidence, a need arises for comparison of the signatures of the respondent on the complaint with her admitted signatures on the written statement and affidavit filed in court.
