The respondents have passed an order dated 4.8.2011 which has been placed on record by respondent No.1 with affidavit dated 9.8.2011. Vide the said order, the petitioner has been treated as Joint Secretary with effect from 1.10.1999, Assistant Secretary from 25.4.2004 and Deputy Secretary from 27.2.2007 by giving notional promotions. The resulted effect is that petitioner has got seniority in the respective cadres with effect from the above-mentioned dates. The only claim left in this petition pertains to consequential arrears of pay.

Since the directions issued by this Court have been substantially complied with, I deem it appropriate to dispose of this contempt petition with liberty to the petitioner to firstly make a representation to the competent authority for the grant of arrears of pay which shall be considered sympathetically and disposed of by passing a speaking in accordance with rules within a period of three months from the date it is submitted and if still aggrieved, the petitioner may challenge the order so passed before an appropriate forum.
