This Court vide order dated 6.9.2010 passed in

Civil Writ Petition No.15583 of 2010 directed the respondents to consider the explanation –cum- objections submitted by the petitioner before taking any final decision in the matter pertaining to

C.O.C.P. No.1172 of 2011 (O & M) [2]

grant of sanction to prosecute respondent No.4 in the writ petition. Alleging non-compliance of the afore-stated order, the petitioner has filed this contempt petition.

The respondent has filed his reply/affidavit and in Para 5 thereof, it is averred that in compliance to the orders of this Court, the whole record was re-examined and on consideration of the said material, a speaking order dated 6.1.2011 (Annexure R-1) has been passed.

From the contents of the reply/affidavit coupled with the order (Annexure R-1), it thus appears that directions issued by this Court have been complied with, leaving no cause to continue with these contempt proceedings which are accordingly dropped, however, with liberty to the petitioner to avail of his remedy, as may be available in law.

Rule discharged.
