The application is allowed and annexed affidavit of Bhuro Kaur (mother and legal representative of appellant No.1 since deceased) is taken on record, subject to all just exceptions.
CM No.14896-C of 2010 and RSA No.3288 of 2001
Appellant No.2-Labh Singh who is brother of appellant No.1-Darshan Singh since deceased filed CM No.14896-C of 2010 for withdrawing the appeal alleging that their father Gurchand Singh (who is legal heir of appellant No.1 since deceased) and also appellant No.2 had effected compromise with respondents and, therefore, withdrawal of the appeal bearing RSA No.3288 of 2001 was sought. Thereafter vide order dated 22.02.2011, Bhuro Kaur mother of appellant No.1 since deceased has been impleaded as his legal representative. Singh father of both the appellants were also annexed with CM No.14896-C of 2010 for permission to withdraw the appeal.
In view of the aforesaid, CM No.14896-C of 2010 is
