The landowner is in appeal before this court seeking enhancement of compensation for the acquired land.

Briefly, the facts are that vide notification dated 19.3.1981, issued under Section 4 of the Land Acquisition Act, 1894 (for short, 'the Act'), the State of Punjab sought to acquire land situated in the revenue estate of village Kotli Nangal, Tehsil and District Gurdaspur, for construction of bye-pass road. The same was followed by notification dated 19.5.1981 issued under Section 6 of the Act. The Land Acquisition Collector (for short, “the Collector”) vide award dated 3.6.1985 assessed the market value of the land @ 17,760/- per acre for chahi/nehri kinds of land. Dissatisfied with the award of the Land Acquisition Collector, the landowners/claimants filed objections. On reference under Section 18 of the Act, the learned court below vide award dated 15.3.1994, determined the market value of the acquired land @ 40,000/- per acre. It is this award which is impugned in the present appeal.

Learned counsel for the parties are ad-idem that the issues raised in the present appeal are squarely covered by judgment of this court in RFA No. 2385 of 1990- Balwant Singh vs The State of Punjab through the Collector and another , decided on 12.11.2009, whereby the compensation payable to the landowners for the acquired land vide same notification was assessed @ ` 45,000/- per acre .
