Rajinder Singh & Anr. Vs Haryana Public Service Commissione & Anr.

Learned counsel for the petitioners has challenged the stipulations in the advertisement notice contained in Clause 11(IV), which inter alia provide for relaxation upto maximum 5 years in age for candidates belonging to Ex Servicemen category.

We have perused the Statutory Rules governing the Haryana Civil Services (Judicial Branch). This condition in the advertisement notice has been incorporated on account of the Statutory Rules namely Punjab Civil Services (Judicial Branch) Rules, 1951 as amended from time to time and applicable to State of Haryana.

These rules are not under challenge. Hence, the challenge to condition of the advertisement is not sustainable.

At this stage, learned counsel for the petitioner wishes to withdraw the present petition with liberty to challenge the rules.

Prayer allowed.

Dismissed as withdrawn with liberty prayed for.
