Learned counsel for the petitioner points out that the petitioner has in fact filed an appeal against the order of Debts Recovery Tribunal (DRT) on 16.9.2011 but that appeal is not being taken up for hearing as the Presiding Officer has not been appointed.
Ms. Deepali Puri, learned Counsel appearing for respondents No.2 to 4 – borrowers, points out that in fact the Bank has also filed an appeal which has been ordered to be taken up on 1.11.2011 by the Debts Recovery Appellate Tribunal (DRAT), Allahabad. It is pointed out that the Presiding Officer of DRAT, Allahabad has been given additional charge of DRAT, Delhi. We order that the appeal of the petitioner shall also be taken up by DRAT, Allahabad on 1.11.2011.
In view of the said fact, no orders are called for in the present petition. The petitioner is at liberty to raise all contentions as are raised in the present petition in appeal before DRAT, Allahabad.
The writ petition stands disposed of.
