The grievance of the petitioner in the present writ petition is that respondent No.3, i.e., Municipal Committee, Cheeka Tehsil Guhla, District Kaithal, has granted contract for the works as mentioned in para 7 of the petition though the said works are already complete.
The writ petition was listed for hearing on 29.09.2011. Keeping in view the averments, the Deputy Commissioner was directed to submit report in respect of the status of the work for which tender has been invited.
Today, the Deputy Commissioner, Kaithal, has filed report pointing out that no tender form was issued to the contractors

for the works mentioned in the tender notice and no tender was allotted to anybody in secret manner. It is also stated that on his direction, SDO (Civil) visited the sites along with Tehsildar, Guhla and Municipal Engineer, Municipal Committee Cheeka and found that no work was done at the spot and no tender was allotted to any body.
In view of the said report, we find that the averments made by the petitioner are not correct. Consequently, the present writ petition is dismissed.
