The petitioners have invoked the provisions of Article 226 of the Constitution of India for quashing the order dated 18.03.1994 (Annexure P-4), whereby respondent No.1 has initiated proceedings for grant of gratuity. The petitioners have further sought dropping of unwarranted proceedings.
Both the parties have contended that the present case is squarely covered by the judgment of this Court in Union of India and another Vs. The Controlling Authority and another , C.W.P. No.13707 of 1994 (decided on 22.05.2009).
Accordingly, the present petition is disposed of in view of the terms and conditions, mentioned in the above said judgment.
