The petitioners seek a writ of mandamus directing the respondents to pay higher grade in accordance with qualifications possessed by them in view of the Government instructions issued from time to time and as per the directions issued by the Hon'ble Supreme Court and this Court in number of judgments, which have held the persons like the petitioners entitled to get the status and placement in category 'B', Group-2. The petitioners have relied upon the admission of CWP Nos.2221 and 5252 of 1991, which were admitted on 8.2.1991 and 9.4.1991 respectively.

No one appears for the petitioners. However, State counsel points out that CWP No. 5252 of 1991 has been decided

on 18.7.2011 and has been disposed of with a direction to grant and release the benefits due to the petitioners within three months from the date of certified copy of the order made available to the respondents. The petitioners in CWP No.5252 of 1991 had approached this Court for grant of pay scale of `110-250 as revised from time to time to JST teacher on the basis of law laid down in various judgments passed by the Hon'ble Supreme Court. It is not disputed that the matter has now been finally settled by this Court in CWP No.3931 of 1992 titled as “Baldev Raj Mittal and others Vs. State of Punjab and others”, where identical prayer has been allowed.

In view of the ratio of law laid down in CWP No.5252 of 1991, the present writ petition is also disposed of in the same terms.
