The petitioner in this petition has prayed for quashing of the order dated 1.12.2009 by which his prayer for running the second shift of Polytechnic classes was declined. During the pendency of the writ petition, the matter was reconsidered and the prayer of the petitioner has once again been declined vide order dated 16.11.2010 because of the deficiencies which were noticed during the course of inspection about which the petitioner has been apprised of. The said decision has been placed on record by way of C.M. No.16604 of 2010.
Notice was issued to the counsel for the petitioner and as per the office report, he has been informed. However, he has not put in appearance.

Since a fresh decision has been taken, the petitioner, if aggrieved thereof, would be required to assail the same.
The instant writ petition is disposed of with liberty to the petitioner to challenge the order which has been passed during the pendency of the writ petition.
