Prabhu Ram & Ors. Vs State of Haryana & Ors.

The petitioners are stated to have filed an appeal before the Collector, Yamuna Nagar at Jagadhri against the order dated 6.9.2006 passed by the Assistant Collector, 2^nd Grade, Mustafabad. The said appeal was adjourned sine-die at one point of time as the application for partition itself was dismissed in default. The partition proceedings have since been restored. The petitioners thereafter applied for hearing of their appeal on merits but their application appears to have been turned down by the Collector, Yamuna Nagar at Jagadhri.

Since the summoning of the opposite party at this stage would unnecessary burden them with litigation expenses and no serious prejudice

is likely to be caused to them, I deem it appropriate to dispose of this writ petition with a direction to the Collector, Yamuna Nagar at Jagadhri that in case any appeal was preferred by the petitioners against the order dated 6.9.2006 passed by the Assistant Collector 2^nd Grade, Mustafabad, let the same be decided in accordance with law and after hearing all the parties likely to be effected from its outcome. The needful shall be done within a period of four months from the date of receiving a certified copy of this order.
