The three writ petitioners who retired as Headmasters/ Headmistress have approached this Court for their correct pay fixation in terms of the Government Circular dated 25.9.1998 (Annexure P-1) and to release the consequential arrears of salary and retiral benefits etc.

Unfortunately, the second respondent, namely, Harinder Kaur Sidhu is stated to have died during the pendency of the writ petition.

It is stated by the learned Additional Advocate General, Punjab representing the respondents that the ACP has been ordered to be released in favour of the petitioners and consequential orders regarding their pay fixation have also been passed.

Learned counsel for the petitioners has pointed out that the resultant arrears are yet to be paid to the petitioners. Similarly, their retiral benefits including the pension needs to be suitably revised. He further points out that the arrears of the revised pay and pension are also required to be deposited in the pension accounts of the petitioners.

Having heard learned counsel for the parties and considering the fact that the respondents have done the needful for the release of ACP to the petitioners, the writ petition is disposed of with the following directions:-

i) the arrears of pay/revised pension shall be deposited in the pension accounts of petitioner Nos.1 & 3 within a period of one month from the date of receiving a certified copy of this order;

¶23

ii) in case the pension account of petitioner No.2 has not been closed so far, her arrears of pay/revised pension shall also be deposited in her pension account and intimation to this effect be sent to her legal heirs. The needful shall be done within a period of one month from the date of receiving a certified copy of this order; iii) however, in case the arrears of pay and revised pension cannot be deposited in the pension account of petitioner No.2, the respondents shall immediately send an intimation to this effect to her legal representatives who shall then inform in writing their bank account where such arrears can be deposited;

iv) in case the petitioners have already withdrawn the arrears, then directions Nos.(i) to (iii) need not be complied with.
