Complaint has been received through post, which was taken on judicial side. As per allegations levelled in the complaint, Sukhwinder Singh father of the petitioner was illegally taken away by some unknown persons.
Learned State counsel has already filed reply by way of affidavit of Gurdial Singh, PPS, Deputy Superintendent of Police, Ludhiana alongwith statements of Sukhwinder Singh and Ravinder Singh, which are on the file.
As per reply, the alleged detenu (Sukhwinder Singh) was arrested in case FIR No.108/09 under Section 392 IPC was registered at Police Station, Sector 20, Panchkula. Thereafter Sukhwinder Singh (detenu) was sent to jail and his identification parade was got conducted in jail. During the identification parade the alleged detenu was found innocent.
Learned State counsel further contends that except FIR No.108 no other case has been registered against Sukhwinder Singh and he is not wanted by Punjab Police.
In view of the above-said reply and statement of alleged detenu (Sukhwinder Singh), the present petition has become infructuous and is dismissed accordingly.
