This petition under Section 439 of Cr.P.C. has been filed by Rajbir Singh—petitioner, for grant of regular bail for the offences under Sections 307, 427/149 and 148 IPC and Sections 25 and 27 of the Arms Act, 1959, in respect of which FIR No. 75 dated 21.6.2011 has been registered in Police Station Sri Hargobindpur, District Gurdaspur.
As per the version given in the FIR, the present petitioner, alongwith other co-accused, had come to the spot subsequently after a telephone call was made by Kuldip Singh @ Billa, accused, and at that time he was armed with a sword. However, no injury has been attributed to him. He is coming in custody since 23.6.2011 and according to his counsel no progress has been made in the trial. The conclusion of the trial will take long time.

Keeping in view the part so attributed to the petitioner and without expressing any opinion on the merit of the case, he is ordered to be released on bail to the satisfaction of the Chief Judicial Magistrate, Gurdaspur, subject to the following conditions:-
(i) He shall not offer any threat, promise or inducement to any person acquainted with the facts of the case so as to dissuade him from disclosing the same to the Investigating Officer/Court; and
The petition is disposed of accordingly.
