By filing this petition, petitioners sought quashing of First Information Report (for short 'FIR') No.28 dated February 15th , 2003 under Sections 406 and 498-A of the Indian Penal Code, Police Station Madhuban, District Karnal (Annexure P-1) on the basis of compromise (Annexure P-2).
In this case, FIR was quashed by Hon'ble Mr. Justice S.S. Saron vide judgment dated December 23rd , 2010. However, the petition was adjourned to enable learned State counsel to seek necessary instructions from the Department of Social Justice and Empowerment of the Haryana Government regarding financial assistance for disabled children with parents who are separated because the parties had already obtained a decree of divorce and the child born out of the wedlock was handicapped.
Ms. Alka Yadav, Deputy Director, Social Justice & Empowerment Department, Haryana, Chandigarh filed her affidavit submitting therein that the financial assistance under the “Financial Assistance to the Non-School Going Disabled Children Scheme” has already been given to the minor child.
In view of above, this petition is disposed of
accordingly.
