Lakhwinder Singh and Anr. Vs State of Punjab and Ors.

This is a petition under Section 482 of the Code of Criminal Procedure praying for quashing of FIR No.194 dated 5.9.2008 under Sections 307/323/324/34 IPC, Police Station Bholath, District Kapurthala along with all the consequent proceedings arising therefrom, on the basis of compromise.

On 7.7.2011, notice of motion was issued and the parties were directed to appear before the learned trial Court on 16.7.2011 to get their statements recorded as it was contended that the matter has been amicably settled inter se between the parties.

The learned trial Court accordingly recorded the statements of the parties on 15.7.2011 and a report to that effect has also been received.

Having regard to the aforesaid when the parties have settled the matter and keeping in view the observations of the Full Bench of this Court in Kulwinder Singh v. State of Punjab and others , 2007(3) RCR (Crl.) 1052, the petition is accepted and the FIR in question along with all the consequent proceedings stands quashed.
