On the last date of hearing, learned counsel for the State had submitted that the petitioner has not joined the investigation. However, learned counsel for the petitioner had submitted that the petitioner is ready to join the investigation but he has never been called by the Investigating Officer. In view thereof, the petitioner was directed to join the investigation on 28.7.2011 at 10.00 A.M and the case was adjourned for 10.8.2011.
Today, learned counsel for the State has submitted that the petitioner did not join the investigation on the said date. In this regard, learned counsel for the petitioner has submitted that he has no instruction as he is not in touch with the petitioner.
The interim bail was granted to the petitioner on 28.6.2011 with the condition that “the petitioner shall cooperate with the investigation and shall not shift his place of residence from where he is presently residing. The petitioner shall also report to the Anti Fraud Staff, District Tarn Taran every day at 10 A.M.”
Learned counsel for the State has submitted that neither the petitioner has reported to the Anti Fraud Staff, District Tarn Taran every day at 10.00A.M. nor he has joined the investigation as directed by this Court on 18.7.2011.
In view thereof, the interim bail granted to the petitioner is hereby vacated and the present petition is hereby dismissed.
