The present petition under Section 482 Cr.P.C. has been filed on behalf of Narang Singh for issuing directions to respondents No.1 to 4 to hold enquiry and take action against respondents No. 5 and 6.

Learned counsel for the petitioner contends that petitioner is in possession of the land to the extent of 1/8^th share out of total land measuring 6 bighas 5 biswas bearing khewat No.154/142, Khatoni No. 271 comprised in khasra No. 27/6-5 and land to the extent of ½ share out of the total land measuring 1 bigha 13 biswas bearing khewat No. 154/142 khatoni No. 276 comprised in khasra No.171 min/1-13 according to jamabandi for the year 2005-2006 situated in village Sekhe, Tehsil Malerkotla, District Sangrur. Learned counsel further contends that

respondents No. 5 and 6 with the help of respondent No.4 are causing wrongful loss to the petitioner and wanted to take forcible possession of the land in dispute and also threatening the petitioner to cut the standing wheat crop sown by him and the crop sown by the petitioner is still standing and the petitioner is not being allowed to cut the same.

Heard the arguments advanced by learned counsel for the petitioner and have also gone through the documents available on the record.

It has been mentioned in the petition that the petitioner has already filed a civil suit for permanent injunction restraining private respondents from dispossessing the petitioner which is pending for today before Civil Judge, Senior Division, Malerkotla.

Since the petitioner has already filed a civil suit before the civil Court and the same is still pending, no direction can be issued at this stage. The petition being devoid of any merit is hereby dismissed.

However, the petitioner is at liberty to pursue representation (Annexure P-2) filed by him.
