Petitioner seeks the concession of regular bail in a case registered at the instance of Inderjit Singh. Originally the FIR was registered on July 20, 2007 alleging that on July 11,2007 Gurlal Singh was assaulted by Nirmal Singh, Gurmej Singh and Jaspal Singh. The FIR was registered under Sections 323, 324, 326, 452, 34 IPC. The petitioner was not named as an accused in the said FIR. Subsequently, on July 22, 2010,

offence under Section 327 IPC was added whereas Gurlal Singh died on July 24, 2010 resulting in adding of offence under Section 302 IPC. After the death of Gurlal Singh, a supplementary statement of complainant Inderjit Singh was recorded on July 24, 2010 naming the petitioner alleging that the petitioner was also present at the time of the occurrence armed with a dang and he had raised a lalkara.
Without expression of any opinion on merits of the case, it is sufficient to observe that no specific injury has been attributed to the petitioner. The petitioner has not even allegedly assaulted the deceased. Petitioner has been in custody since October 19, 2011. Petitioner can be granted the concession of bail.
Petition is allowed. Petitioner is ordered to be released on bail on his furnishing bail bonds/ surety bonds to the satisfaction of the trial Court.
