Defendant no.1/petitioner has filed the present revision petition under Article 227 of the Constitution assailing the order dated 19.10.2011 whereby the learned trial court while declining the prayer for adjourning the case has proceeded to close the cross examination of PW1 Gurdev Singh Mahal.
At the time of arguments, learned counsel for the petitioner in view of observation made by the trial court in the impugned order itself that the defendant/petitioner would be at liberty to summon the original file of civil suit no.385 of 20th September 1986, decided on 16th October,1987 titled as Rupinder Singh v.Sukhdial Singh and others, for which the request for deferring the cross examination was

being made in order to summon the PW1,does not press this revision petition and prays for withdrawal of the same in view of the observation made by the learned trial court.
