Present revision petition has been preferred to assail the order passed by the lower appellate court Annexure P-2, dated 29.7.2010 whereby ad-interim injunction granted by the trial court was vacated. On August 31, 2010, while issuing notice of motion, a Coordinate Bench had passed the following order:-
“Learned Counsel for the petitioner, inter-alia , contends that interim injunction granted by the trial court has been reversed by the First Appellate Court on the ground that the exchange deed is not signed by all the legal representatives of Nanha although the petitioner is in possession. Notice of motion for 23.9.2010.
Status quo be maintained.”
In the present case, suit was instituted on 6.2.2008; a period of
more than three and a half years is going to elapse. The proceedings arising out of the suit may be near culmination. Counsel for the parties are not in a
position to acquaint this Court regarding the current status of the suit. Considering the fact that order of status quo passed by this Court is in vogue since 31.8.2010, present revision petition is disposed of by directing the parties to maintain status quo till the decision of the suit.
