This revision petition is directed against the order dated 12.04.2010 passed by the learned Rent Controller, Faridabad by which an application filed by the landlord/petitioner for amendment of the eviction petition to incorporate the amount of rent from 2,000/- or 2,500/- per month to `1,500/- per month, has been declined.

Learned counsel for the petitioner submits that no prejudice is going to be caused to the respondent as the respondent/landlord has mentioned the initial rate of rent in his eviction petition at the rate of 1,000/- per month. The petitioner is only seeking amendment to incorporate the rate of rent from 2,000/- or 2,500/- per month to 1,500/- per month, but the learned Rent Controller has declined the application only on the ground that the amendment cannot be allowed after the trial has commenced.

After hearing both learned counsel for the parties and keeping in view the facts and circumstances of the case specially that it would not cause any prejudice to the respondent, the rate of rent is allowed to be amended from 2,000/- or 2,500/per month to `1,500/- per month because rest of the pleadings would remain the same.

In view thereof, the present revision petition is allowed and the impugned order is set aside.
