The present revision petition has been filed praying that a direction be issued to the Court of Additional Civil Judge (Sr. Division), Malerkotla to decide Civil Suit No.7 dated 8.1.2005 at the earliest, as the defendant-respondents to the suit were delaying the same without any reasonable cause. It is pleaded in the present revision petition that petitioner is about 67 years of age and is in the corridors of the Courts since 2005.

This Court had called for the tentative schedule from the trial Court. The trial Judge in his communication dated 7.9.2011 has submitted that the suit can be decided within three months. The relevant portion of the

communication reads as under:-

“It is further respectfully submitted that the Civil Suit No.07 of 8.1.2005, BT No.302 of 19.08.2009 titled as Padam Krishan Sood Vs. Gopal Krishan Sood, in question, is pending in this Court for evidence of the plaintiff. It is pertinent to mention here that three other civil suits bearing civil suit No.12 of 10.01.2005, civil suit No.139 of 3.5.2008 and civil suit No.333 of 3.11.2008 pending between the parties, have been consolidated with the present suit, vide order dated 24.1.2008. It is further respectfully submitted that the suit in question being consolidated with three other civil suits, requires at least three months' period for disposal. Undersigned assures your good self to make every extraneous effort to dispose of the suit in question within the said tentative period of three months.”

In view of the tentative schedule submitted by the trial Judge,

the present revision petition is disposed of and the trial Court is directed to decide Civil Suit No.7 dated 8.1.2005 within three months from the date of receipt of a certified copy of this order.
